A Muslim cleric was charged before a Nakuru court for defiling a 15 year-old minor on July 2012 in Nairobi.
Sheikh Mustafa Murtadha who appeared before court was charged that on the month of July 2012 he defiled the 15 year old minor; charges that he denied.
Prosecution side told the court that the accused who was on the run was arrested by police on Sunday at Moi airbase in Mombasa as he was allegedly trying to flee to Lebanon urging the court to deny the cleric bond.
However, the accused through his lawyer Cliff Ombeta declined the application by the prosecution to deny bail to his client saying that the prosecution has not provided any compelling reason to hold his client.
The magistrate in his ruling concurred with the defence saying the prosecution has not provided any compelling reason hence releasing the accused on a Sh 800,000 bond, a surety of the same amount or an alternative cash bail of Sh 300,000.
He further directed that the accused deposit his original passport in court pending hearing of the matter on May 28.
